01 Acceptance of terms

By accessing the site or submitting a form, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the service.

02 The service

PeakForecast is a forecasting and market-intelligence platform. The platform is currently offered as a pre-launch beta. Features may be incomplete, change, or be withdrawn at any time, and availability is not guaranteed.

03 Beta program

Beta access is provided on an "as available" basis for evaluation. We may add, modify, suspend, or discontinue any part of the beta, and may limit or revoke access, at our discretion and without liability. Feedback you provide may be used to improve the product without obligation to you.

04 Eligibility

You must be at least 18 years old and able to form a binding contract to use the service. If you use the service on behalf of an organisation, you represent that you are authorised to do so.

05 Acceptable use

You agree not to:

• Use the service unlawfully or for any fraudulent or harmful purpose.
• Attempt to gain unauthorised access to, disrupt, or reverse-engineer the service.
• Submit false information or another person's data without permission.
• Scrape, copy, or resell any part of the service or its content without consent.

06 Fees

The beta is currently free and does not require a credit card. We may introduce paid plans in the future; any fees and their terms will be presented to you before they apply.

07 Intellectual property

The service, including its software, design, logos, and content, is owned by Peak Forecast and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable right to use the service in accordance with these Terms. All rights not expressly granted are reserved.

08 No financial or investment advice

PeakForecast provides data, forecasts, scores, and analytics for informational purposes only. It is not financial, investment, legal, tax, or trading advice, and nothing on the service constitutes a recommendation to buy, sell, or hold any asset. Forecasts are inherently uncertain and may be inaccurate. You are solely responsible for your decisions and should consult a qualified professional. Past performance does not guarantee future results.

09 Disclaimers

The service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or secure.

10 Limitation of liability

To the maximum extent permitted by law, Peak Forecast and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising from your use of the service. Our total liability for any claim will not exceed USD 100 or, if greater, the amount you paid us (if any) in the 12 months before the claim.

11 Indemnification

You agree to indemnify and hold harmless Peak Forecast from any claims, damages, or expenses arising from your misuse of the service or violation of these Terms.

12 Termination

We may suspend or terminate your access at any time, with or without notice, including for breach of these Terms. Provisions that by their nature should survive termination will survive.

13 Governing law

These Terms are governed by the laws of the State of South Carolina, United States, without regard to its conflict-of-laws rules. The state and federal courts located in South Carolina will have exclusive jurisdiction over any disputes.

14 Changes to these terms

We may update these Terms from time to time. Material changes will be reflected by the "Last updated" date, and continued use after changes constitutes acceptance.
